| Title to the merchandise of this sales order does not pass from our company to purchaser until merchandise is paid in full. |
| HY Furniture reserve the right to cancel this sales order at any time by notifying the purchaser in writing and returning any monies received on account against this sales order. |
| HY Furniture will not be liable for delays or failure to ship due to war, strikes, floods, accidents, government demands or priorities, labor disturbances, shortages of supplies or materials or other conditions beyond our control or the manufacturer's. Cancellation by the customer of this sales contract will result in the forfeiture of the required deposit. NO CASH REFUNDS ARE AVAILABLE. |
| It is your responsibility to check your order for accuracy especially with regard to style numbers, finish, and fabric choices. Errors in pricing or arithmetic are subject to correction. |
| We are not responsible for fit and/or entry of furniture in your home. We will gladly provide you with dimensions of any or all furniture prior to purchase. |
| HY Furniture Gallery does not guarantee the durability, wearing quality, and fastness of color of fabrics, vinyl's, or leather products, however, they will be covered under the manufacturer's warranty if warranty is available. |
| Floor samples and Clearance items are sold as is and are not covered under warranty. |
Return Policy: |
There will be NO refunds on any merchandise that has been accepted by the customer. In the event that merchandise we deliver has a defect, we will inspect the furniture in your home, and repair or replace at our discretion. |
There is NO return for any “custom items”and "Special Orders". |
| No orders will be accepted back without prior authorization by HY Furniture Gallery . The refund for your order in the full amount of your order less all delivery charges and a 20% restocking fee to accept the return of the item by the manufacturer will be processed to you after the item is received back by the warehouse. All refunds must be accompanied by original sales order receipt. |
| All returned products must be in original condition and packaging, furniture has been assembled already can NOT be return. |
| DELIVERY |
| After the furniture is packed, it's shipped via less-than-truckload (LTL) common carrier. Once the shipment arrives to the destination terminal, the freight company will call the receiving customer to let them know it has arrived and provide the customer with the carrier's phone number to call to schedule delivery. |
| The LTL common carrier will use a 28' or 48' tractor trailer unit to make delivery. The delivery will be made with one driver and the trailer will not have a liftgate. The customer must have someone on hand at delivery to provide assistance to the driver during unloading. Additional people may be required depending on the size of the order being delivered. The LTL carrier's obligation is to unload the shipment to the customer's curbside. It is the customer's responsibility to take the furniture inside the home. |
| After unloading and before the driver leaves, the customer should inspect the furniture for damage. Product damage is rare, however, if damage occurs the customer should note the damage in the appropriate box on the Delivery Receipt (provided by the driver) and then sign. |
| Contact the freight company immediately and a claim will be filed. (Note: If there are any tears, indentations, or holes on the exterior of the package, but no damage is found, the customer should still note on the Delivery Receipt that the packaging contained holes and/or tears.) |
| The delivery time for the Curbside Delivery method is 10-14 business days. |
Shiping to Alaska |
HY Furniture Gallery will deliver your order to the Barge Terminal for no charge regardless of size or value. Customer is responsible to arrange and pay for the barge transport. |
